Terms of Service

1. Acceptance of Terms

By accessing or using Profolio ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

Profolio is a resume building platform that allows users to create career profiles, generate tailored resumes, and utilize AI-powered tools to improve their job application materials. The Service includes both free and paid subscription tiers with varying features and usage limits.

3. User Accounts

3.1 Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We may terminate or suspend your account and access to our services at any time, without prior notice or liability, for any reason, including but not limited to if you breach these Terms, engage in conduct that we determine to be harmful to the Service or other users, or for any other reason at our sole discretion.

Upon termination, your right to use the Service will immediately cease. If your account is terminated, we may delete your User Content at our discretion. You may also terminate your account at any time by contacting us or through your account settings.

4. User Content

4.1 Ownership

You retain ownership of all content you submit to the Service, including your career profile information, resume content, and any other materials you create or upload ("User Content").

4.2 License to Profolio

By submitting User Content, you grant Profolio the right to use, store, and process your content solely for the purpose of providing and improving the Service. We may use aggregated and anonymized data derived from your use of the Service to improve our services, develop new features, and enhance our product offerings. This license terminates when you delete your account, except for aggregated and anonymized data which does not identify you personally.ght

4.3 Content Restrictions

You agree not to submit content that:

• Is false, misleading, or fraudulent
• Infringes on intellectual property rights of others
• Contains malicious code, viruses, or harmful components
• Is unlawful, defamatory, obscene, or otherwise objectionable
• Violates the privacy or publicity rights of others

5. AI-Powered Features

The Service includes AI-powered features to assist with resume improvement and career guidance. You acknowledge that:

• AI suggestions are provided as recommendations only and should be reviewed before use
• AI-generated content may not always be accurate or suitable for your specific situation
• You are responsible for reviewing and verifying all AI suggestions before including them in your materials
• AI features are subject to usage limits based on your subscription tier

5.1 Usage Limits

Profolio is currently in beta testing. During this period, we reserve the right to modify, revise, or throttle AI usage limits for all subscription tiers, including the Pro plan, at our discretion. Such changes may be implemented to:

• Ensure fair usage and service stability for all users
• Manage operational costs and resource allocation
• Optimize service performance and reliability
• Prevent abuse or misuse of AI features
• Comply with third-party service provider requirements

We will make reasonable efforts to notify users of significant changes to usage limits via email or in-app notifications. While we strive to maintain consistent service levels, usage limits may be adjusted without advance notice if necessary to maintain service integrity. As we transition out of beta, we will work toward establishing more stable and predictable usage allowances for each plan tier.

6. Subscriptions and Payments

6.1 Subscription Plans

Profolio offers various subscription plans, including free and paid tiers. Each plan provides different features, usage limits, and capabilities as described on our pricing page.

6.2 Paid Plans

Some features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay all applicable fees. Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected by you).

6.3 How Subscriptions Work

When you subscribe to a paid plan:

• Your subscription will automatically renew at the end of each billing period unless cancelled
• You will be charged the then-current rate for your plan at each renewal
• Your payment method will be automatically charged on the renewal date
• You will have access to all features included in your plan during the active subscription period

6.4 Billing

Payments are processed through our third-party payment provider, Stripe. You agree to provide accurate billing information and authorize us to charge your payment method for all fees incurred. You are responsible for keeping your payment information current.

6.5 Cancellation

You may cancel your subscription at any time through your account settings or the Stripe customer portal. To cancel:

• Navigate to your account settings
• Select "Manage Subscription" or access the Stripe customer portal
• Follow the prompts to cancel your subscription

Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds will be issued for the remaining time in your billing period. After your subscription ends, your account will revert to the free plan, and you will lose access to premium features.

6.6 Price Changes

We reserve the right to modify our subscription prices and plan features at any time. When you subscribe to a paid plan, the price and features you receive at the time of subscription are locked in for the duration of your subscription. Price changes will only apply to new subscribers or if you change your plan tier. Your subscription will continue at your original price and feature set as long as you maintain continuous service.

However, we reserve the right to adjust pricing for all users in exceptional circumstances (such as changes in payment processing fees, regulatory requirements, or significant changes to our service costs). In such cases, we will provide you with at least 30 days advance notice via email, and you will have the option to cancel your subscription before the new price takes effect if you do not agree to the change.

Usage Limits: As noted in Section 5.1, during our beta period, AI usage limits may be revised or throttled for all tiers, including paid plans, to ensure service stability and fair usage. These adjustments are not considered changes to your subscription price and may be implemented as needed to maintain service quality.

6.7 Refunds

Refunds may be provided at our discretion on a case-by-case basis. Generally, we do not offer refunds for partial billing periods. Please contact us at support@profolioapp.net if you believe you are entitled to a refund.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Profolio and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

8. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Resell, sublicense, or redistribute access to the Service
• Use the Service to generate spam or unsolicited communications
• Attempt to reverse engineer or decompile any part of the Service

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Profolio does not guarantee that use of the Service will result in job interviews, offers, or employment. The effectiveness of your resume depends on many factors beyond our control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROFOLIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers or your personal information
• Any errors, mistakes, or inaccuracies in the Service
• Any content or conduct of third parties on the Service

11. Indemnification

You agree to indemnify and hold harmless Profolio, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

13. Changes to Terms

We reserve the right to modify, amend, or update these Terms at any time at our sole discretion.

14. Age Restrictions

Our Service is not intended for individuals under 16 years of age. By using the Service, you represent and warrant that you are at least 16 years old. We do not knowingly permit anyone under 16 to create an account or use our Service. If we become aware that a user is under 16, we will promptly terminate their account and delete their information.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
